The bankruptcy procedure for individuals began in Kazakhstan

Today in Kazakhstan the acceptance of applications for bankruptcy of individuals began. You can apply for out-of-court bankruptcy online.

If a citizen submitted an application to the bank for loan refinancing and was refused, he needs to obtain a certificate from the bank or microfinance organization. If a response has not been provided, a copy of the application or confirmation of sending the application in electronic format is required.

After receiving a certificate or a copy of the application, the debtor can file for bankruptcy online through the E-salyg Azamat service, the eGov.kz portal and the eGov mobile application, as well as through self-service corners in public service centers. The State Revenue Committee of the Ministry of Finance of the Republic of Kazakhstan will consider the application within 15 working days.

When filing for bankruptcy, the following requirements will be taken into account:

- there should be no property, including joint ownership with a spouse;

- a response was received from the bank regarding the refusal to refinance the loan;

- in pre-trial proceedings, the debt should not exceed 5 million 520 thousand tenge;

- the loan was not repaid within 12 months.

At the same time, for citizens who have received targeted social assistance for 6 months, the last point of the requirements does not apply.

Let us remind you that out-of-court bankruptcy entails a ban on obtaining loans for a period of 5 years and monitoring of financial condition for 3 years after bankruptcy.
